2. USO DEL SITIO WEB

The simple access to the Web Site attributes to the user the condition of user of the same (hereinafter, "the User"), and implies that he/she accepts all the terms set forth herein. In case of not agreeing with the present terms, the user must immediately leave the Website without using it.

Lo de Manuela's website is not directed to persons under 18 years of age. By using the Website you represent and warrant that you are over 18 years of age.

Lo de Manuela is a Web Site, on-line store, where a set of products can be purchased. If the User decides to acquire one of the products, he/she will be fully responsible for accepting the contracting conditions, exempting Lo de Manuela from any type of responsibility for non-compliance.

Lo de Manuela indica en su Sitio Web un conjunto de productos y precios relcionados. Dichos precios pueden actualizarse. Si el Usuario, por la información facilitada, quiere contactar con Lo de Manuela dispone de puntos de contacto facilitado para ello. El Usuario es conocedor de lo expuesto, y entiende que la información facilitada en el Sitio Web no puede dar lugar a ningún tipo de reclamación hacia Lo de Manuela.

4. EXCLUSIÓN DE RESPONSABILIDAD

The User's access to the Website does not imply for Lo de Manuela the obligation to control the absence of viruses, worms or any other harmful computer element. It is up to the User, in any case, the availability of adequate tools for the detection and disinfection of harmful computer programs.

Lo de Manuela is not responsible for damages caused to the software and computer equipment of the User or third parties during the use of the services offered on the Website, nor for damages of any kind caused to the User as a result of failures or disconnections in the telecommunications networks that cause the suspension, cancellation or interruption of the Website service during the provision of the same or prior to the same.

Lo de Manuela may, at its sole discretion and without prior notice, temporarily or permanently suspend the accessibility and/or permanence of the Website on the Internet, as well as the services offered through it. In no case Lo de Manuela will assume any responsibility derived from such acts.

5. CONTENIDOS Y SERVICIOS ENLAZADOS A TRAVÉS DEL SITIO WEB

6. PROPIEDAD INTELECTUAL E INDUSTRIAL

All the contents of the Web Site, which are understood to include, but not limited to, texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound contents, as well as its graphic design and source codes, are the intellectual property of Lo de Manuela or third parties, and none of the exploitation rights recognized by the current legislation on intellectual property on the same may be understood to have been transferred to the User.

The trademarks, commercial names or distinctive signs are owned by Lo de Manuela or by third parties, without it being understood that access to the Web Site attributes any right over them to the User.

In the event that the User is allowed to publish directly or through Lo de Manuela on the Website, the User grants to Lo de Manuela, on a non-exclusive basis, free of charge, for the entire world territory and for the maximum period of protection legally provided for, all the rights of reproduction, distribution, public communication and transformation, with the purpose that the services requested or used by the User may be provided correctly.

The User will be able to obtain information about the treatment of personal data that we carry out in this Web Site, through the link to the Privacy Policy.

8. NULIDAD E INEFICACIA DE LAS CLÁUSULAS

If any clause included in the Conditions operating in this Web Site is declared totally or partially null or ineffective, such nullity or ineffectiveness shall only affect such provision or the part thereof that is null or ineffective, the remaining Conditions subsisting in all other respects and such provision being considered totally or partially as not included.

Lo de Manuela will pursue the breach of these conditions, as well as any improper use of its Web Site exercising all civil and criminal actions that may correspond to it by law.

The non-exercise or non-performance by Lo de Manuela of any right or provision contained in these Terms of Use shall not constitute a waiver thereof, unless expressly acknowledged and agreed to in writing by Lo de Manuela.

9. LEGISLACIÓN APLICABLE Y JURISDICCIÓN COMPETENTE

Estas Condiciones de uso se regirán e interpretarán conforme a la legislación española. Lo de Manuela y el Usuario acuerdan someter cualquier controversia que pudiera suscitarse entre ellos por el acceso y/o uso del Sitio Web a los Juzgados y Tribunales de Barcelona, salvo que la ley establezca otra cosa .
